Title I, Part C Eligibility Screener

01 Child / Youth Status

34 CFR §200.81(a) · the individual must be under 22 when the recruiter is working to make the determination and not have earned a diploma or equivalency.

Age at time of the move

Has earned a diploma or GED

02 Qualifying Move

A residence-to-residence move, crossing a school district (or federally established administrative) boundary, made for economic necessity. Any factor indicating the move was made to earn or save money satisfies economic necessity — the family need not state a hardship in their own words.

Moved to a new residence

Crossed a school district / administrative boundary

Move was made to obtain paid work, or otherwise to earn or save money

03 Migrant Agricultural Worker Qualification

NRG Ch. II · a qualifying move within 36 months, plus new temporary/seasonal ag or fishing work obtained within 60 days — or the Actively Sought exception. Temporary work must last less than 12 months.

Move occurred within the preceding 36 months

New qualifying agricultural/fishing work was obtained within 60 days of the move

If work was not obtained: documented evidence of actively seeking eligible work

Demonstrated recent history of moves for temporary/seasonal ag or fishing work

04 Move Alignment & QAD

The child moved with, to join, or preceded the migratory agricultural worker — and if separated, is the child joining the worker within a reasonable timeframe (less than 12 months).

Relationship of the child's move to the worker's move

If separated: to join completed within ~12 months

05 Nature of the Work

34 CFR §200.81 · must be agricultural or fishing production/initial processing, and temporary or seasonal — permanent employment (anything over 12 months) does not qualify.
